"VSC off" 4th gear limit

Skip past the first paragraph to read the important stuff.

So I stopped by the dealer today. One of the bolt covers on the driver's side A pillar handle keeps opening up. They ordered me a new one after they tried to fix it. There is also a problem with the rear seatbelts (port leather). One seatbelt sticks about 2 inches above the seat and won't go any lower. The other seatbelt drops down through the bottom and won't stay up in the seat. The high one leaves imprints in the seat back when the seats are folded and the low one disappears under the seat when you try to buckle the seatbelt. I don't think either of them were put in properly.

While I was there, I mentioned that when I have the VSC off, the truck sometimes does not shift past 4th gear. I have to either switch over to S mode and up shift or switch to S mode and then back to drive to get it to work. It's been happening more and more. He said he hadn't heard of the problem before and would have it looked at (along with a rear seatbelt issue) when I could drop it off with them after the new part comes in.

Today I started the truck after lunch, turned the VSC off and drove to a stop light before getting on the interstate. At the light, I switched over to S mode and then back to D to see if I can cancel the problem before it happens. I am behind a slow 18 wheeler getting on the interstate and I punch it to get around him when there is an opening on the interstate in the next lane. I get around him and my engine is really wound up. I let off the gas expecting it to shift and it doesn't. I'm doing 80 and the tach is reading close to 5500 rpm. Not good. I switch it to S mode and back to D and it's OK after that. The other day I was doing about 70 on the interstate and had the same problem. When I switched over to S mode, it went to 3rd gear first instead of 4th gear like it is supposed to. Not good. Supposedly this is a common known issue with Toyota. It's supposed to be a software problem and also exists in their other cars like the Camrys.

If nothing else, at least I will have the issue documented with them should it cause any other kind of problem like a blown engine the way it's going. I have under 900 miles so better to document it now. I know I could just go into S mode and into 6th gear all the time. But the thing is, I shouldn't have to do that every time I drive with the VSC off.
