Truck stolen from oil change shop

My boss sold me his 2008 Crew Max 4wd TRD, 3400 miles, 5 weeks ago. It has been garage kept, looked brand new. Took it to get oil changed and when oil tech finished he drove it out of the bay, left keys in truck, came in lobby to ring me up. Some kid walking by jumps in and takes off. Owner of shop says he's not responsible, it's their policy to leave keys in while finishing paper work. Is this unreal? Cops call this morning and found truck wrecked. Any advice on how I don't come out at a loss? I hate having to get a lawyer, just seem's you never get back to even.

get a lawyer.

let cooler heads prevail.
It still angers me when I think about my truck being stolen a few years back( a dodge ram).
I would sue them to no end.
and make sure everyone you know and all their friends don't do business with them. ever.

That may be their policy but, does not absolve them of responsibility. I would say that they are responsible for the auto until they give you your keys back. Sloppy procedure on their part.

Get a lawyer.

They are responsible for sure. The shop should take reasonable care of you truck while they are performing a service for you. Reasonable care is keeping your keys under their control until they finish the job and return them to you. Get a lawyer.

Any shop I take my truck to I make sure they know it stays locked and if for some reason it spends the night at the shop it goes inside, period! I don't know why you would be responsible for it though, if it was wrecked or damaged while in their care its their fault. Since you never got your keys back the truck is still in their hands.

I don't think a lawyer is necessary. Go back to the shop, tell him you spoke with an attorney who would be more than happy to file a suit against him, and say that you would prefer to not waste money/time going that route. $100 says the shop owner knows he's responsible.

I agree with Rone, bluff first then spend some money if you have too.
