Yah it shouldn't happen but if it does TURN OFF THE VEHICLE! And slowly steer towards the side of the road with hazards on.

Not that I'm an expert in accident theories, but personally, I think the key-less ignition requirement to hold the button for 3 seconds before it kills the engine is a more believable causal affect theory as to what actually happened here re.ac.tor.

Pure speculation: he's unfamiliar with the loaner car, accelerator sticks for whatever reason, he pushes the kill button and nothing happens (maybe even a couple of times but never for the required 3 seconds), then tries to put it in neutral, but the sports shifter makes that difficult especially when you're traveling that speed, he slams on the brakes until he burns them up.... then ultimately a tragic fatal accident.

I have to wonder if there's not some other problem with the accelerator on some models. I also can't imagine why they would set a 3 second requirement on the kill button.... after all, for those of us without the key-less system, we don't have a delay if we turn our key off (and I realize that wrong buttons sometimes get pushed, but a 3 second requirement?). Anyhow, I just cannot imagine that this thing boiled down solely to a floor mat holding the accelerator... if it did, then why didn't he just simply reach down and pull it out of the way?

Of course they are, its in the governments best interest! Have to recover the money somehow.

I do feel terrible for the family, they should be compensated by Toyota voluntarily.

Not the mats for sure.
They will act like cruise control not increase acceleration. Happened to me twice on 2 different cars and break and pull mats and there you go.

HARD TO BELIEVE THAT POLICE OFFICER WOULD NOT KNOW MANY WAYS TO STOP A CAR!

Been a while since I've been around the site, but thought i should add to this thread.
I had a similar problem with my 2000 tundra.
Pulled up to a stop sign and stopped.
The throttle jumped up and the truck started moving out into the intersection.
I literally STOOD on the brakes to try to hold the truck in place.
It jumped a couple times, moving the truck out far enough that after the throttle backed off on its own after a few seconds, I had to back up to get the front bumper out of the crossing lane. It never happened again after that, but considered selling it off. I never did hear back from the NTSB after I reported it, probably because I was not the original owner, though it was a Toyota Certified vehicle, complete with an aftermarket bumper.
